Malice and Aforethought
Superior Judge Hiller Zobel has freed Au Pair Louise Woodward from all murder charges. Zobel explained his reasons for not accepting the jury's guilty verdict as the lack of malice. He however did say that confusion, fright, and bad judgment were shown but rage and malice were not.
What is Judge Zobel talking about?! Who is responsible for the baby's death?
If not Louise Woodward then it should be the mother. After all, Baby Matthew is dead. Someone caused his death. If the Au Pair showed confusion and bad judgment then let her pay for her actions with some kind of remorse.
But no, Louise stated that she is not guilty of anything. Her behavior with the baby is accepted as normal and now the jury's verdict is considered wrong. To allow the defendant to be convicted "would be miscarriage of justice" stated the judge.
One of the reasons we have laws is to teach people responsibilities. The consequences of not obeying the laws is punishment. The lessons of punishment instruct people to live with discipline and act with restraint.
I know that when people are not accountable for their actions society falls apart. Please don't consider me brutal and harsh. Being for an investigation of child abuse?
District attorney, Tom O'Reilly, for Middlesex County, where the case was heard has said: "I've never seen anything like it." You can be sure his sentiments are felt by many others.
I have been told that Judge Zobel is a father and grandfather. He has what it takes to understand. "I do not denigrate Matthew Eappen's death, nor his parents grief" stated the judge. So why doesn't he send out a clear and unequivocal message for someone to take responsibility!
It's been reported that at times Judge Zobel brings flowers to court. I think he ought to bring flowers to Baby Matthew's grave and ask forgiveness.
